Ex-Mayor of Vladivostok condemned

Primorsky Regional Court dismissed the cassation brought by the prosecution of Vladivostok on charges of the dismissed mayor Vladimir Nikolayev, who was convicted on 4,5-year suspended sentence for abuse of power.

As the lawyer said Olga Nikolaeva Korovin, on Wednesday at the meeting of Primorsky regional court, the court decided to reject the appeal brought by the prosecution of Vladivostok.

February 5, 2008, in the Primorye regional court of Leninsky district court received a criminal case against Vladimir Nikolayev. The appeal consideration of the criminal case was held today, Feb. 20. The court session was held in public.

The prosecutor's office filed a protest to Vladivostok on the decision of the Leninsky district court of Vladivostok, which is 24 December 2007 was sentenced Vladimir Nikolayev to 4.5 years' imprisonment and stripped him of his right to occupy leading positions in three years. Nikolaev fully admitted his guilt. After the verdict, he was released from custody on his own recognizance.

In December, the investigating authorities did not agree with the sentence imposed by V. Nikolaev, considering it too soft, and sent to the court of cassation representation. Head of the Vladivostok Administration Nikolaev was accused of "abuse of power" (Part 2 of Article 285 of the Criminal Code) and "exceeding official authority" (part 2 of article 286 of the Criminal Code). Today, however, Primorsky regional court dismissed the cassation brought by the prosecution of Vladivostok.

A source in the prosecutor's office, from today sentenced Vladimir Nikolayev came into force, but the theoretical possibility of appeal still exists, reports Pravda.Ru .
