Movement "Resistance" amends legislation to protect witnesses and poterpervshih

Today in Moscow held a press conference dedicated to amending the legislation to ensure strengthening the rights of victims and witnesses in criminal proceedings.

On January 1, 2005 came into force the Federal Law "On state protection of victims, witnesses and other participants in the criminal process." Nevertheless, the evaluation of professional and expert community, this document has not yet been able to become an effective instrument of Russian justice in connection with the lack of enforcement provided them security and social support to victims of crime.

In early 2007, initiated the movement "Resistance" on the basis of the Duma committee on criminal, procedural and arbitration law has established an interdepartmental working group to develop amendments to the criminal law. It is composed of Duma deputies, Public Chamber members, by specialists from the Interior Ministry and Federal Security Service, the lawyers movement "Resistance". The first package developed by the amendments introduced by the procedure in the State Duma.

In particular, the bill introduces a procedural figure applicant as the person who sold the bodies of preliminary investigation of the impending, being committed the crime. The applicant shall have very important rights, including the right to seek the application of safeguards under the Criminal Procedure Code. The same rights accorded a suspect, defendant, expert, specialist, interpreter, witnesses.

In addition, provides for the possibility of the suspect or accused of such preventive measures as detention when there is a threat to the victim, witness or other parties to criminal proceedings.

Considerable attention is paid to the legal drafters of the criminal procedural safeguards, namely the protection of personal data is protected persons detained in a criminal case, and the use of an alias.
