International Court of Justice begins hearings on the measures of defense of Georgia to the Russian Federation

From 8 to 10 September the International Court of Justice in The Hague held hearings on the question of provisional measures, which insists on the adoption of Georgia, in connection with her lawsuit, which it accuses Russia of violating the International Convention on the Elimination of All Forms of Racial Discrimination. As a result of the forthcoming meetings of the Court must first determine whether it has jurisdiction over the lawsuit filed by Georgia and whether the situation conditions which should require the adoption of provisional measures.

Monday will hear initial statements plaintiff and defendant. Then follow the response performance. In a statement issued on 12 August in the International Court of Justice appeal Georgia insists that on the basis of this Convention "were fully guaranteed and protected personal rights of all persons on the territory of Georgia."

The Georgian side claims that "the Russian Federation, through its public authorities and other agencies performing the state power officials and other individuals and through the South Ossetian and Abkhazian separatists acting on the instructions of or under the direction and control of the Russian Federation has committed serious violations of their fundamental obligations under the Convention . In the Georgian-treatment alleged that Russia had violated its obligations under the Convention, in certain periods of its intervention in South Ossetia and Abkhazia from 1990 to August 2008.

Georgia requests the Court to the UN "to oblige the Russian Federation to take all necessary measures to comply with the obligations arising from the Convention." As a basis for the Court's jurisdiction, Georgia and recalls Article 22 of the Convention. The statement also said that Georgia reserves the right to accuse Russia of violating the Convention on the Prevention and Punishment for him that involved both Russia and Georgia.
